User agreement and terms of service
  1. Parties

    This User Agreement (hereinafter referred to as the "Agreement"), is between AMA Sigorta Aracılık Hiz. Ltd. Şti. (hereinafter referred to as "AMA Sigorta" or “We”) operating through (hereinafter referred to as "Website") and the User (hereinafter referred to as the "User"), the User's use of the Website and in the electronic environment where the Website is located.

    By logging into the website, the user states that he/she has read the entire Agreement and accepts and declares that he understands and approves all its provisions.

    (AMA Sigorta and User hereinafter are collectively referred to as the "Parties".)
  2. Definitions
    • Content: All kinds of information, files, pictures, published or accessible on the website, number, visual, literary and auditory images.

    • Service: Insurance to be offered to the User by AMA Sigorta within the scope of the website service(s).

    • Agreement: means this User Agreement.

  3. Subject and Scope of the Agreement

    This Agreement governs the terms of services provided by AMA Sigorta operating in the insurance sector to the User and rights and obligations of the Parties.

    The user has read and understood the "User Agreement" and "Data Protection and Processing Policy" and will not be able to proceed to the next steps without his/her express approval.

  4. Terms of Service

    The person who wishes to receive the Service on the Website, without entering the requested information, can enter into this Agreement may not have the right and authority to be a defined User. Under the age of 18 or a minor those who are not, limited and do not have the power of appeal, but their parents or legal representatives through which they can transact. Otherwise, all transactions will be invalid.

  5. Intellectual Property, Copyrights

    AMA Sigorta is the sole and exclusive owner of the Website, including any and all copyright, patent, trademark, trade secret and other ownership and intellectual property rights, in and to the Website and any related materials and documentation. No title or ownership of the Website or any portion thereof is transferred to the User hereunder. AMA Sigorta reserves all rights not expressly granted hereunder. User agrees not to change or delete any copyright or proprietary notice related to materials downloaded from the Website.

  6. Responsibilities

    All other responsibilities shall belong to the User while using the Website, which violates any compliance of law and legislation, taking any action that imposes an unreasonable and disproportionately large load on the Website, for reasons such as unauthorized connection and unauthorized use, unfair and unlawful of the Website.

  7. Indemnification

    AMA Sigorta shall not be liable for any damage resulting from false or incomplete information given by the User, especially the health or personal data for obtaining the services. In the event that claims, damages, losses, liabilities, judgments, costs or expenses (including reasonable attorneys' fees and costs) are made against AMA Sigorta by a third party because of the absence of correctness or timeliness of the User’s data and information, the respective User undertake to fully indemnify AMA Sigorta. Users shall also fully indemnify and hold AMA Sigorta harmless from and against any claims, damages, liabilities, costs, losses and expenses arising out of (i) Users' negligent breach of these terms and (ii) Users' negligent violation of any third party right, including without limitation any intellectual property, right of publicity, or privacy right.

  8. Force Majeure

    It is accepted and acknowledged that AMA Sigorta shall not be liable for any loss or damage caused to the User as a result of delay or default or deficiency or failure in the Services as a result of any natural disasters, fire, riots, pandemics, civil disturbances, actions or decrees of governmental bodies, communication line failures (which are not caused due to the fault of AMA Sigorta or the Third Party Service Providers), or any other delay or default or deficiency or failure which arises from causes beyond AMA Sigorta’s reasonable control (“Force Majeure Event”). In the event of any Force Majeure Event arising, AMA Sigorta, depending on whose performance has been impacted, shall immediately give notice to the Other Party(s) of the facts which constitute the Force Majeure Event.

  9. Applicable Law

    This agreement shall be construed in accordance with applicable Turkish Laws.

  10. Termination

    If User violates the terms of this Agreement, his/her ability to use the Website will be terminated. AMA Sigorta may, in its sole discretion, terminate User’s access to the Website, or any portion thereof, for any reason whatsoever without prior notice. Further, AMA Sigorta shall not be liable to User or any third party for any such termination or discontinuance. User may terminate this Agreement by ceasing to access and use the Website. To the extent permitted by applicable law, the disclaimers, limitations on liability, termination and User’s warranties and indemnities shall survive any termination of this Agreement.

  11. Changes to the Agreement

    We have the right to amend, adapt or supplement the present these terms of the Agreement from time to time. The current version of the Agreement can be found on our Website.

    If User does not agree to any or all of the changes made by us to this Agreement, he/she may cease using our Website and its services with immediate effect.
